2. Eligibility

3. The marketplace
Hyde Trading Co. operates a buy-and-resell marketplace for pre-owned luxury goods. Hyde purchases items outright from sellers after authentication and resells them to buyers. Hyde is the principal in every transaction, not a consignment agent.
4. Accounts
You are responsible for the activity that occurs under your account. Notify us immediately of any unauthorized use.
5. Acceptable use
You agree not to submit counterfeit goods, misrepresent the condition or provenance of items, harass other users, or use the Site for any unlawful purpose. Violations may result in suspension or permanent account closure.
6. Limitation of liability
To the maximum extent permitted by law, Hyde Trading Co. and its affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Site.
7. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law provisions.
8. Changes to these terms
We may update these Terms from time to time. Material changes will be communicated by email or in-app notice. Continued use of the Site after an update constitutes acceptance.

- Request a copy of that information
- Request deletion of your information (subject to legal retention requirements)

5. Retention

Authenticity Guarantee
Our two-stage authentication promise.

1. Our promise
Every item sold by Hyde Trading Co. passes two stages of authentication. First by HydeAI, our internal AI-powered intake review. Then by hand, by our trained specialists who physically examine the item, its hardware, hallmarks, papers, and provenance.
2. What "authenticated" means at Hyde
An item marked "Authenticated" on Hyde has been physically inspected at our facility by a qualified specialist, with all available verification methods applied to that category (visual inspection, hardware testing, hallmark verification, brand-specific fingerprinting where supported). Authentication is a professional opinion based on inspection — not a guarantee from the original brand.
3. If an item is later found to be inauthentic
If you purchase an authenticated item from Hyde and a qualified third-party authenticator subsequently determines it to be inauthentic, contact our support team within thirty (30) days of delivery with:
- The Hyde reference number from your order
- The third-party authenticator's written report
- The original packaging and all included materials
We will refund the full purchase price including original shipping costs, and arrange return shipping at our expense.
4. Limitations
This guarantee does not cover items modified, repaired, or altered after delivery; items damaged in shipping after our handover to the carrier; or items where the buyer provides authentication opinions only from non-qualified sources.
5. Categories not covered
Some categories on Hyde — such as fine jewelry without serialized hallmarks, or items pre-dating modern authentication infrastructure — are sold subject to specialist opinion only and may carry different terms. Such items are clearly marked on their product page.

Returns & Refunds
When and how items can be returned.

1. Return window
You may request a return within seven (7) days of delivery for any reason. Items must be returned in the same condition received, with all original packaging, papers, dust bags, and authentication tags intact.
2. How to start a return
Open your portal, navigate to My Orders, find the order in question, and select "Request return." Our team will issue a prepaid return shipping label and instructions within one business day.
3. Refunds
Once your return arrives and is inspected by our team, we will process a refund to your original payment method within five (5) business days. Refunds include the original purchase price; shipping is refunded only if the return is due to a Hyde error (authenticity dispute, item not as described, our shipping damage).
4. Final-sale items
Items marked "Final Sale" on the product page are not eligible for return except under our Authenticity Guarantee. These items typically include heavily-discounted pieces and bespoke or pre-owned items where condition was extensively documented at sale.
5. Damaged or wrong items
If your item arrives damaged or is materially different from the product page, contact our support team within forty-eight (48) hours of delivery with photographs. We will arrange a free return and full refund.
6. Shipping for returns
Hyde ships all returns prepaid and insured via the same carrier and service level used for the original delivery. You are responsible for packaging the item securely for return transit.

Seller Terms

1. What it means to sell on Hyde
Hyde Trading Co. operates a buy-and-resell model. When you submit an item, our team reviews it, and if we accept it, we make you an offer. If you accept the offer and ship the item to us, we authenticate it in person and pay you within five (5) business days of successful authentication.
2. Your representations as a seller
By submitting an item for sale, you represent and warrant that:
- You are the legal owner of the item or otherwise authorized to sell it
- The item is authentic to the best of your knowledge
- The item is not stolen, counterfeit, or subject to any third-party claim
- You have accurately disclosed the item's condition
- All photographs and information you provide are truthful
3. Offers
Offers are based on current market conditions, the item's authenticated condition, and demand for the category. Offers are valid for seventy-two (72) hours from when they are sent. After 72 hours the offer expires and a fresh review is required.
4. Shipping your item to us
If you accept an offer, Hyde will provide a prepaid, insured shipping label. You must package the item securely and ship within seven (7) business days of receiving the label. Items lost or damaged in transit are covered by carrier insurance up to the offer amount.
5. Authentication outcome
Upon arrival, our specialists physically authenticate the item. If the item passes authentication and matches the represented condition, we issue payment within five (5) business days. If the item fails authentication or is materially different from how it was represented, we will contact you to discuss the discrepancy. You may choose to have the item returned to you at our expense.
6. California secondhand dealer law
California Business and Professions Code §21626 requires marketplaces dealing in jewelry, watches, and certain other categories to hold items for thirty (30) days before reselling. This holding period applies to your item before it appears for sale, and it does not affect your payment timing.
7. Reporting and tax
As a buy-and-resell operation, Hyde does not currently issue 1099 forms to private sellers in most cases. You are responsible for reporting any income from the sale of personal property to the appropriate tax authorities as required by law.
8. Prohibited items
Hyde does not accept counterfeits, items with serial numbers removed or altered, items obtained illegally, or items in categories not currently supported by our authentication process. Submission of prohibited items may result in account suspension.
